the problem with both constitutions is there is no actionable, defendable language. nothing any law can be based on. "personal liberty" and "social responsibility" are not anything law, litigation or prosecution could be based on. no rights the average citizen can cite in their defense. if anything it would be the content of some sort of declaration of independence. a constitution imposes actionable responsibilities and restrictions on the government as well as establishing and codifying the rights of the citizenry

I agree. So you are talking about laws right? or as X/facebook call them 'rules'.  My proposal is that I carefully go through X laws and apply then to Ximboland. Howeverf i am concerned that many of the laws themselves are still subjective. hate conduct for example. One persons hateful conduct is another persons freedom of speech right? So we are still going to need a Justice Minister to interpret these laws.
I will start with the Ximboland hateful conduct laws and revert back

in most countries, there is a body of multiple judges whose job is to study and interpret those laws, not a single all-powerful individual. legally this is referred to as a system of checks and balances. there are legal definitions for things like incitement of violence, the intent to terrorize, etc. these are the actual legal grounds for prosecuting and/or defending oneself from a hate crime or violent speech

Yes though this is different because we are asking a Minister to be both the police and the judge at the same time. Compare it to the UK - if someone breaks the law they are arrested by a police officer. The police officer doesn't need to also then sentence the person and work out of they are guilty or not. In this case we are asking a minister to be both the judge and the jury which is tricky and also means they need to make decisions in real time. It means mistakes may happen and it means we have to put up with their subjective views of our constitution and laws

taken by the NHS against this nurse:

A Christian nurse has been suspended from her role in Britain’s National Health Service after she spoke out about allegedly being disciplined for refusing to refer to a biologically male convicted paedophile patient as a woman.

Jennifer Melle has been suspended by the St Helier Hospital in Carshalton, London over allegedly breaching patient confidentiality after she spoke out about being previously disciplined by the NHS Trust for refusing to use female pronouns when referring to a male convicted child sex abuser while under her care.

Despite Melle claiming that the patient had racially abused her and physically threatened her, the Nursing and Midwifery Council (NMC) determined that she was “a potential risk” for refusing to acknowledge the paedophile s preferred “gender identity”.

According to Melle, after she refused to abide by his pronoun demands, the child sex offender

: “How about I call you n*****?… Yes, black n*****!”

After speaking to the press last month over the incident, Melle received word last week that she had been suspended from her position for violating the child sex offender’s confidentiality. This comes despite Melle not publicly disclosing the name of the convict, who is currently incarcerated in a high-security prison after being found guilty of sexually abusing multiple boys after posing as a teenage girl online.

The nurse has vowed to launch a lawsuit against the NHS Trust, claiming harassment, discrimination and human rights violations.

Ok so here goes on the updated constitution and laws. Apologies in advance its all quite long winded but I believe its he time to get this right so please give as much critical feedback as you can muster - 

                              Constitution


The establishment of the Fashionable republic of Ximboland is a response to the widespread demand for a democratic alternative to autocratic social media governance. The world’s major social media platforms claim to be based on good will and fair governance however most seek to impose their world-view on all of their users.


Ximboland recognizes that democracy is the antidote to this problem.

We present an alternative to dogmatic social media governance - an alternative that is democratic, fair and created for Ximbos by Ximbos.


The constitution of the fashionable republic of Ximboland is based on the key principles of the 2002 Amsterdam Humanist declaration, the UK laws and both Twitter/Xs and metas terms of service.


The Fashionable republic of Ximboland affirms the worth, dignity and autonomy of the individual and the right of every Ximbo to the greatest possible freedom compatible with the rights of others. Ximbos have a duty of care to all Ximboland including future generations. The Fashionable republic of Ximboland believes that morality is an intrinsic part of Ximbo nature based on understanding and a concern for others, needing no external sanction.


The Fashionable republic of Ximboland seeks to use science creatively, not destructively. Ximboland believes that the solutions to the world’s problems lie in Ximbo thought and action rather than divine intervention. Ximboland advocates the application of the methods of science and free inquiry to the problems of Ximbo welfare. But Ximboland also believe that the application of science and technology must be tempered by human values. Science gives us the means but human values must propose the ends.


The Fashionable republic of Ximboland supports democracy and Ximbo rights. Ximboland aims at the fullest possible development of every Ximbo citizen. It holds that democracy and Ximbo development are matters of right. The principles of democracy and Ximbo rights can be applied to many Ximbo relationships and are not restricted to methods of government.


The Fashionable republic of Ximboland believes that personal liberty must be combined with social responsibility. Ximboland ventures to build a world on the idea of the free Ximbo responsible to society, and recognizes our dependence and responsibility for the natural world.


The Fashionable republic of Ximboland is undogmatic, imposing no creed upon its adherents. It is thus committed to education free from indoctrination. Xod exists for all and no-one.


The Fashionable republic of Ximboland values artistic creativity and imagination and recognises the transforming power of fashion and art. Ximboland affirms the importance of literature, fashion, music, and the visual and performing arts for personal development and fulfilment.

               Laws of the Fashionable republic of Ximboland


Ximbolands purpose is to serve the world by offering a truly democratic alternative to the established, familiar and autocratic social media platforms.


This means that our laws change, shift and evolve over time as decided by Ximbos for Ximbos.   Whilst this means that change is a relatively constant occurrence we believe that this is a price worth paying in order to defend democracy and to keep Ximboland free from the oppression and totalitarianism that envelopes other platforms.


In Ximboland we have 2 sets of legislation - Presidential or Palace laws (sometimes called fixed laws) and governmental or Pink house laws (sometimes called flexible laws because they regularly change).  


The Presidential (Fixed) laws are set in stone and can not be changed by anyone except the President , Miss Bimbo Sindy Laarson I. These laws are long term in their nature.


Pink House or flexible laws can be changed by the elected Ximbo government of the day. Where possible we try to ensure as many laws and aspects of Ximboland are flexible and can be changed by the elected government of the day. Because government terms last only 3 months these laws are sometimes subject to regular change.


For example laws around adult content are ‘flexible’ and decided in the Pink House. To some Ximbos adult content has no place in Ximboland and should be banned. To others adult content is a form of self expression and is therefore actively encouraged.

Laws around violent content in Ximboland are mostly flexible and decided in the Pink House by the government of the day. We also have a small number of laws around violent content that are fixed/Presidential legislation.


Laws around violence in Ximboland that are decided in the Pink House (flexible)
At one extreme an elected government may decide that violent content is completely prohibited in Ximboland whilst other governments may allow certain violent content to be openly shared in Ximboland.

Most violent content laws are flexible and decided by the government of the day. Some governments may allow our users to share graphic and violent media. They may feel that they want Ximboland to be a place where people are encouraged to express themselves, learn about what’s happening in the world, debate global issues, and share images and videos as part of the conversation. They may take the opinion that news coverage is often violent and to suppress this would impinge on our ability to have conversation and damage our freedom of speech.

However other governments may feel that healthy conversations can’t thrive when violent speech is used to deliver a message, and not every participant wishes to be exposed to violent Media. As a result, some governments may remove or reduce the visibility of Violent Content to ensure the safety of our users and prevent the normalization or glorification of violent actions.


Laws around violence in Ximboland that are Presidential/Fixed
We have a number of inflexible laws around violence and these include the outlawing of violence that is excessively gory, violence that is sexual in nature, threatening violence on others or, inciting, glorifying, or expressing the desire for violence. They are strictly prohibited and not allowed at any time by Ximbo or any government.


Violent Entities and perpetrators of violent attack
Most laws around violent entities revolve are fixed legislation emanating from the President's office.

Presidential laws (fixed) on violent entities
There is no place in Ximboland for violent entities and perpetrators of violent attacks including (but not limited to) terrorist organizations, violent extremist groups, perpetrators of violent attacks, or individuals who affiliate with and promote their illicit activities. The violence and hate these entities engage in and/or promote jeopardizes the physical safety of those targeted.

Ximbos may not threaten violence, terrorism and/or violent extremism, nor promote violent and hateful entities.

Violent entities are those that deliberately target Ximbos, Xuggles or essential infrastructure with physical violence and/or violent rhetoric as a means to further their cause. These include, but are not limited to, terrorist organizations, violent extremist groups, and perpetrators of violent attacks.

Under this law, Ximbos can’t affiliate with or promote the activities of violent entities. Examples of the types of content that violate this law include, but are not limited to, doing the following on behalf of, indirectly, or directly for a violent or hateful entity:

Engaging in or promoting violent acts

Recruiting, or providing or distributing services (such as media/propaganda) to further stated goals

Sharing manifestos or beliefs of violent perpetrators even if its shared with good intentions.


Pink House/flexible laws around violent entities
Some governments may make limited exceptions for violent and hateful entities if they can determine the following:

They have reformed or denounced their violence and/or hate-based purpose.

They are currently engaged in a peaceful resolution process.

They are state or governmental entities, including those that have representatives elected to public office.

Additionally Ximboland governments may allow, encourage or even facilitate discussions of violent and hateful entities for clearly educational, documentary, and/or newsworthy purposes.

Any Ximbo citizen can become Prime Ximbo using the democratic process. Its a 2 stage process from Senator>Prime Ximbo. All Ximbo xitizens can vote in general elections but in order to put themselves forward to become Prime Ximbo/a minister they must first become a Ximbo senator.

Can I become Prime Ximbo more than once?
Yes ­ a Ximbo can hold the position of Prime Ximbo for 6 terms max.

How often do elections take place?
The Fashionable Republic of Ximboland holds elections every 3 months for Prime Ximbo and every 3 months for State Ministers.

Where do important discussions take place?

What is the treasury/ministers/Prime Ximbos salary?
The treasury/salary is the bank account of The Fashionable Republic of Ximboland. This figure is transferred to the paypal account of the Prime Ximbo at the end of their 3 month term in charge.

The treasury is funded by the Ximbo xenators.
A percentage (33%) of the money paid by Ximbo xenators via Paypal is transferred into the Ximbo treasury. The rest is used for further Ximboland development.
