The facts of the case

Today, at 17:10 XL time, in the thread 'a pre-emptive note,' wherein an announcement was made regarding the 2024 US presidential election and user behavior following it, a post was made by the defendant, @Bimbo Pimp. Through direct messages discussing the validity of the punishments given regarding this post, Bimbo Pimp expressed the desire to defend themselves through the court. The message is attached here:

The message, upon review was deemed to be in violation of the following rule located in the Ximboland Terms of Service:
Hateful Conduct – Attacking others based on race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease are all not permitted.

The claims made against Bimbo Pimp

The message written by Bimbo Pimp is in reference to the congresswoman Sarah McBride, the first trans congressperson in United States history. The message "Did you see what Delaware elected into office" addresses McBride as an object, seemingly intentionally. The discussion on an elected person, in a respectful manner, is encouraged by myself. However, this post's insinuations are not respectful. Referring to a person as an object is, in my opinion, an attack on them. McBride has been a matter of discussion as of late, not for her political platform, but for her identity as trans woman. The attacking of a woman on the basis of gender is considered a violation of Terms of Service, which I have no power over altering.
The proliferation of hate speech by a website is a reason given by Cloudflare, the most prevalent internet provider to remove a website from their services, rendering it inaccessible. The knowledgeable condonement of such behavior may render Ximboland inaccessible across the internet, losing both userbase and income for its workers, not to mention the unsafe environment it fosters for the largely diverse userbase of Ximboland.

If Bimbo Pimp is found guilty

The enforcement procedures detailed in my post state that Bimbo Pimp will be jailed for 3 days. No further action will be taken after the sentence is served.
